Terms of Use

1. Agreement
These Terms of Use ("Terms") govern your use of ClickCert, a study aid for the California LCSW Law & Ethics exam operated by Theo Atallah ("ClickCert," "we," "us") at clickcert.atallah.link. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service. These Terms apply for as long as you use the service; your account and our obligations under it are also governed by our Privacy Policy.
ClickCert is in beta. Features, availability, and pricing may change as the service matures. Material changes to these Terms will be posted on this page with an updated effective date; continued use after a change constitutes acceptance.
2. Eligibility and accounts
You must be at least 18 years old and preparing for (or interested in) the California LCSW Law & Ethics exam to use ClickCert. You agree to:
- provide accurate registration information and keep it current;
- keep your password confidential — you are responsible for activity under your account;
- use one account per person; do not share credentials.
We may suspend or terminate accounts that violate these Terms.
3. Acceptable use
ClickCert is for personal study. You agree not to:
- scrape, crawl, harvest, or systematically bulk-download any part of the service, including questions, rationales, citations, or page content, by automated or scripted means;
- copy, reproduce, republish, upload, transmit, or redistribute questions or answer explanations outside the service, in any form, including sharing account access to excerpt content;
- attempt to circumvent rate limits, access controls, or technical measures we use to protect the content and the service;
- use the service unlawfully; interfere with or disrupt the service; probe or scan it for vulnerabilities without written permission; or reverse engineer portions of it except as permitted by law;
- misrepresent your identity, or use the service to impersonate others.
4. Enforcement; bans and refunds
We may investigate suspected violations. If we determine, in our reasonable judgment, that you or your account (a) scraped, harvested, systematically downloaded, or attempted to extract content, or (b) otherwise abused the service, we may act with or without prior notice: we may throttle or suspend access, and/or terminate the account permanently ("ban"), with no refund of any fees paid or amounts outstanding. A banned account may not be re-registered under the same or a different identity. We may also preserve records of the activity and disclose them to service providers, platforms, or law enforcement where required or appropriate under law. No refund applies to fees for the period in which the violation occurred or to fees already paid.
5. Ownership of content and license to you
The questions, answer options, rationales, citations, code, design, and all other content and materials in ClickCert (the "Content") are owned by ClickCert and its operator and protected by copyright and other laws. Questions in the bank originate from ClickCert's independent authoring; they are not copied from, nor are they the confidential property of, any exam administrator. We do not claim rights in the underlying statutes, regulations, or ethics codes cited in the Content — those belong to their respective sources, and citations are provided as scholarly references.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and display the Content for your own individual exam preparation. Everything not expressly granted is reserved. Any permitted use of the service or its Content beyond that license is without the permission of ClickCert and would constitute copyright infringement and/or breach of contract; we reserve all rights and remedies.
6. Feedback
If you send suggestions or feedback, you grant us a perpetual, royalty-free license to use it to improve the service, without obligation or attribution.
7. Availability; changes
We aim for continuous availability but provide the service "as is" during beta; scheduled or unscheduled downtime may occur, and features may change or be withdrawn. We are not liable for unavailability, including during exam-prep-critical periods, and we do not guarantee that content will be retained, or results achieved, from any study period.
8. Disclaimers
ClickCert is a study aid only. It is not the exam, and it is not legal advice. Content is written from cited primary sources for educational purposes and may contain errors or become out of date. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. ClickCert is not affiliated with, endorsed by, or sponsored by the California Board of Behavioral Sciences (BBS), Pearson VUE, NASW, ASWB, or any government body.
9. Limitation of liability
To the maximum extent permitted by law, ClickCert's aggregate liability arising out of or relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost study time, or exam outcomes. If you are a California resident, you may have rights that this section cannot limit under California law; nothing here limits liability that cannot be limited by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless ClickCert and its operator from claims, damages, and reasonable costs arising from your violation of these Terms or your use of the service in a way that is not authorized by them.
11. Termination
You may stop using the service at any time. We may suspend or terminate your access for violation of these Terms, with the consequences described in Section 4, or for any other reason on notice (for accounts in good standing, notice will be reasonable). On termination, your license to the Content ends immediately.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Sacramento County, California, unless mandatory law gives you a different forum.
